The present General Terms and Conditions of Use are intended to define the conditions of access and navigation on the website by the client who intends to make purchases in the online shop. The General Terms and Conditions of Sale aim to regulate the terms of operation of transactions between Barbot e Bernardo Lda. and the client. The Privacy and Data Protection Policy aims to identify the privacy protection measures with regard to the processing of personal data and the free movement of data of individuals, including the tools for personalized management of personal data provided by customers.
I - GENERAL CONDITIONS OF SALE
The use of this website automatically attributes the condition of the user and implies the acceptance, full and unreserved, of all the provisions included in the Terms and Conditions and Privacy and Cookies Declaration, in the version in force at each moment in which the user accesses the website.
If you do not fully accept any of the conditions set out, you should not access or use our website. You may use the website without any registration. However, some functionalities of the same may be dependent on registration.
The user will be responsible for the content of the information sent or transmitted to the website.
To the maximum extent permitted by law, the company declines any responsibility, direct or indirect, for use of the website.
We reserve the right to change these Terms and Conditions without prior notice. The user is bound by the version of the Terms and Conditions at the time of use, and we, therefore, recommend that you consult them periodically.
1.1 - ORDER AND PURCHASE PROCESS
The ordering process is possible without the registration of the customer in the online shop, and the customer should follow the various sequential steps of the ordering process that will allow the registration of the purchase.
Deadlines and Payment Methods
After the completion of the order process, the purchase will be registered and you will have a period, indicated in the payment method selected, to make the payment of the same. After this deadline, if there is no confirmation of payment the order will be canceled. No personal data of the customer will be kept so their management should be done directly with the provider of the respective payment service. Except in situations in which the service provider allows the management of personal data to be made directly on our website, in which case, provided that they are in accordance with applicable legal provisions, particularly with regard to the protection of personal data, the indications issued by that provider will be complied with. In any case, there is no storage of any payment data entered by the customer unless the supplier's platform allows it and the customer expressly consents to it.

You can pay for your order by credit card using the Viva Wallet application available in the checkout process on our website.
After completing the order through the online shop, the customer will receive the IBAN required to make the payment and thus confirm your purchase. After making the bank transfer, the customer should send proof of transaction to the following email: firstname.lastname@example.org
After completing the order through the online shop, the customer will receive an indication of the telephone number to which he can send the payment via MBWAY. When sending the payment, the order number should be indicated
Order shipment deadlines
The shipping deadlines indicated will be met under normal order processing conditions, except for situations of exceptional increase in the volume of orders that may occur during festive periods or during promotional campaigns, as well as other eventualities that prevent the regular provision of the delivery service.
The client may cancel his order if it has not yet been sent. To do this, you may contact Saber Fazer's shop by email, using the provided.
The cancellation of orders is only possible through the process mentioned above. Any request made by any other means cannot be answered.
1.2 - Delivery Process
Once the order has been shipped, the customer will receive a confirmation e-mail.
Saber Fazer's shop offers several regular delivery services, which are subject to the procedures of each carrier, particularly about the information needed to effect the service, the modalities, deadlines, costs, and transport constraints associated with the specifics of the orders to be delivered and the mechanisms to validate the identity of the recipient of the purchase or the third party representing it. Saber Fazer's shop is unaware of any change in the conditions of service provided by carriers, being responsible only for ensuring that the procedures followed by them in the delivery process correspond to the terms in force at the time of the conclusion of the purchase. The specificity of some product segments may justify the establishment of a minimum purchase value, which will always be indicated in the last phase of the order process.
Thus, the delivery options presented may vary depending on the type of products to be delivered, the geographical area of destination, and the type of delivery method desired.
The delivery times, counted from the effective date of dispatch of the order, are indicative and are only considered valid when there are no physical or structural impediments (e.g. incorrect addresses or force majeure eventualities, such as strikes, loss of connection, bad weather, etc.).
The customer may choose to receive the order at an address of their choice. To do this, you must provide the address where you will be present between 09h00 and 19h00 on the day of delivery. An attempt of delivery will be made by a courier of the chosen transport service to the address indicated.
It is not possible to choose a specific delivery time as it will depend on the courier's route on the day of delivery, which is defined by the transport service.
The indication of an incorrect or incomplete delivery address may imply the return of the order to Saber Fazer's shop and lead to additional costs for the client. For this reason, we recommend that the client always make sure that the delivery address, indicated when registering the order, is effectively correct and complete. Once the order is sent it is not possible to change the delivery address or the billing data indicated.
In any case, for reasons of a service organization and the transport companies' distribution procedures, the recipient's identification data will be printed on a label that will be placed on the outside of the shipping box. In the case of the personal data of customers, it is advisable to destroy or erase them after receiving the order in order to prevent such information from being consulted by third parties after the disposal of the packages at the recycling points.
Orders destined for non-European Union countries, regardless of the value of the product, are subject to Customs control and it may be necessary to pay tax charged in the country of destination. The costs of any Customs tax are the responsibility of the customer, their value depends on the Customs policies of each country.
Shipping costs are automatically calculated by the system and may depend on the following factors:
- the value of the order;
- the segment of products ordered;
- delivery address;
- carrier tariffs, which are periodically updated;
Likewise, shipping costs will be automatically updated as the customer adds items to the shopping cart.
All the purchase conditions will be clearly indicated in the order process and immediately before the confirmation of the respective purchase.
Right to Free Contract Resolution
In compliance with the provisions of Articles 10 and 11 of the legal regime applicable to contracts concluded at a distance and away from business premises, the client may exercise his right to free termination of the contract within 14 days from the day on which the client, or a third party designated by him other than the carrier, acquires physical possession of the product ordered or if the order is composed of several articles that will be delivered on different days, from the day on which physical possession of the last of the articles delivered is acquired. To exercise this right, you should send Saber Fazer's shop, before the end of the period indicated above, an unequivocal statement of contract resolution and, for this purpose, use the email contact provided.
The procedures described in the annex to this document, as well as the provisions of paragraph 1.3 below (Returns), will apply to the exercise of this right. In this context, Saber Fazer's shop will proceed to refund the amount that the client may have paid, except for delivery costs. The client will be responsible for the costs of returning the articles.
Within 24 hours, Saber Fazer's shop will acknowledge receipt of your communication of intention to terminate the contract.
The refund can be made through the original method of payment or a refund coupon. The option for the reimbursement method through a reimbursement coupon will depend on the express manifestation of that will by the client. In this case, the customer accepts the condition that the refund coupon is valid for 12 months from the date of issue of the coupon and, at the end of this period, there will be no further refund.
Procedures applicable in case of incidents
If an order is returned to Saber Fazer's shop for reasons attributable to the same, the order will be reshipped, assuming the costs of the new shipment.
If the reason for the unsuccessful delivery and return of the order is the responsibility of the forwarder, regardless of the payment method chosen, the client will have to present a written complaint which will be analyzed by the forwarder. Alternatively, and always dependent on the prior and express consent of the client to do so, the complaint submitted by the client to Saber Fazer's shop may be sent to the carrier as support for the incident created on the grounds of non-delivery.
1.3 - Returns and Exchange Procedure
In addition to the conditions specifically set out in the previous number, the customer should also take into account if the product they want to return was purchased under any promotional campaign and if, for that reason, benefited from any product offer. If this is the case, the customer should return not only the product in question but also the offer that was given with the purchase. Both products must comply with the aforementioned guidelines.

The return of incomplete, damaged or scratched products, as well as products without the original packaging and/or label, or products with evidence of having been used, will not be accepted.
Each one of the articles to be returned must, therefore, be sent in the above mentioned conditions, and the shipping company's label must be glued in the original transport box, or in another alternative that guarantees the good conservation of the product, being that one destroyed after the confirmation of the conservation state of the returned product(s).
If any of the above conditions are not met, the customer will lose the right to be refunded, in which case the customer will have 10 days to collect the article(s) in question at the above mentioned facilities, bearing the costs of the respective collection.
The collection should be performed by a freight forwarder hired by the customer since it is not possible to collect the order in person by individuals, even if the customer themself.
If any item is not received under the conditions mentioned above, the customer will lose the right to a refund and will have 10 days to collect the item(s) at the above mentioned facilities, bearing the collection costs.
Saber Fazer's shopwill do its best to refund the client promptly, safeguarding, however, a maximum period of 15 days from receipt of the order at our facilities.
Return shipping costs
If Saber Fazer's shop is notified and it is confirmed that there was an error in the product(s) shipped or that the product(s) was shipped with a defect, Saber Fazer's shop will cover the costs of the return.
1.4 - Product Information
All the necessary procedures to guarantee that all the details, descriptions and prices of the products presented on the site are in conformity with the legal requirements are strictly followed. However, situations may occur in which product information, including prices and promotional campaigns, has not been correctly published. In these cases, Saber Fazer's shop reserves the right not to follow up on orders with these products. If the client places an order for these products, a Saber Fazer employee will contact the client and inform him/her of the impossibility of continuing the process.
Orders may also not be sent for other reasons, such as
- stock rupture
- inability to obtain authorization of payment;
- order considered fraudulent;
As the products may, at any time, be subject to restrictions or impediments to the commercialization in the country of the delivery address, the customer must ensure the compliance of the product purchased with the legislation applicable in that territory, regardless of the possibility of occurrence of customs or border control. Whenever detected in a timely manner, any restriction to the commercialization of a product will imply its placement in a state of stock shortage.
All products, campaigns, promotions and offers are limited to the physical stock available and/or the units stipulated for the campaign.
Saber Fazer's shop also reserves the right not to allow the conclusion of the purchase process if any situation is detected, in addition to those specifically described in this document, resulting from a computer error in the process of creating the order, in any of the phases subsequent to this and associated with the logistical treatment of the same, as well as the effect of the knowledge or imposition by the competent authority of any restriction on the sale of the products it sells. To avoid this last situation, customers are advised to verify, whenever possible, the conformity of the product in question with the regulations applicable to the country of delivery address.
Payments are always made in Euros.
1.5 - Guarantee
Being the access to goods and services corresponding to those contracted and with the guarantee of correct functioning one of the fundamental rights of consumers, Saber Fazer's shop will guarantee, for a period of 24 months from the date of purchase (except in the case of perishable goods), the quality of its products, offering clients, in cases where it is demonstrated to be legitimate, one of the following solutions, in this order:
- Repair of the damaged good, guaranteeing correct functioning and/or final quality;
- Exchange of the good for an identical good;
- Exchange of the good for a good that is similar in characteristics and purpose, as long as agreed with the customer;
- Contract resolution and consequent reimbursement, if none of the previous options is possible;
The exercise of the right to warranty by the customer will always take place upon presentation of the complaint to the Customer Care service and the return of the defective item or the item that does not correspond to the contracted one.
The Customer Support service will analyze the article in question in order to confirm the effective right to the guarantee by the customer, excluding all situations that are proven to result, among others, from:
- Abusive use, intentional damage or negligent damage by the customer;
- Normal wear and tear of the product, as long as it is within the expected levels declared by the manufacturer;
- Impossibility of proving the malfunction or defect indicated by the customer;
- All situations that are detected as attempted fraud;
After the evaluation of the product received, the client will be informed of the decision regarding his request. In cases where the warranty is to be exercised, Saber Fazer's shop will promote the repair, replacement or refund of the article in the shortest possible time, the expected deadline being communicated by email to the client, through which the right to activate the product warranty will be confirmed.
The refund of any amount paid will be made by the same means of payment used to purchase the product, unless otherwise agreed with the customer.
These provisions are without prejudice to any rights of the consumer arising directly from the law in force.
1.6 - Suggestions and Complaints
The opinion of clients is very important to Saber Fazer as it allows the implementation of improvements in the services provided. If for any reason the clients are not satisfied with the services or with any of the goods purchased, or if they have any suggestions, Saber Fazer would appreciate if you could report any situation within 14 days of the occurrence or receipt of the order by the recipient or by a third party designated by you, to one of the contact channels of the Customer Service.
The customer must also keep in its possession, until otherwise indicated by Customer Service, either the defective, damaged or non-compliant product, or the respective box of the order.
If, at the time of delivery of the order, the outside of the box is not in perfect condition, the customer should reject the delivery under the penalty of not accepting the complaint.
